ClusterDX Terms and Conditions and Community Code of Conduct

Welcome to ClusterDX, an online community and set of tools for 11-metre radio enthusiasts. Basic membership is free. By registering, accessing or using ClusterDX, you confirm that you have read and accepted these Terms and Conditions and agree to follow this Community Code of Conduct.

1. Purpose, legal responsibility and eligibility
ClusterDX provides information, community features, a DX cluster, logbook tools and other radio-related services. You are responsible for understanding and following the laws, licensing requirements and radio regulations that apply in your country. ClusterDX does not authorise radio operation and is not responsible for how members use radios, transceivers or other equipment.

Information supplied through spots, member profiles, messages, links, activations, contests and other user-generated content may be incomplete or inaccurate. Use it at your own discretion. You must be legally permitted to use the service and must provide truthful registration information.

2. Community language and respectful participation
English is the standard language for public community content on ClusterDX so that moderators and members can understand one another. Callsigns, recognised radio codes and short greetings in another language are acceptable where appropriate. Content that cannot reasonably be moderated may be removed.

Treat other members, moderators and staff with respect. Harassment, threats, bullying, personal attacks, deliberate provocation, discrimination, racism, hate speech, sexually explicit content and disruptive arguments are not permitted. Political campaigning and religious disputes do not belong on ClusterDX. The same standards apply to profiles, Nickpages, photos, comments, chat, private messages and every other ClusterDX feature.

3. Registration, callsigns and account security
Register only for yourself and use a valid callsign that you are entitled to use. Do not impersonate another operator, share an account, sell or transfer an account, or register an account on somebody else's behalf without prior approval from ClusterDX administration. You are responsible for protecting your password and for activity performed through your account.

Portable, mobile, maritime-mobile and QRP identifiers may be used where appropriate. If your principal callsign or DX group changes, contact the administration before changing your identity on ClusterDX. Repeated callsign changes are not permitted. Staff may request reasonable confirmation when a callsign or group membership is disputed and may suspend the account until the information is corrected.

4. Free and additional callsign accounts
One Basic account for one callsign is free. Creating undeclared duplicate accounts is not permitted. If you need a separate account for another callsign, it must be arranged through the additional account plan. An additional Basic account costs EUR 25 per year. Its access is available only during the paid period.

An active Platinum membership includes one Platinum account and two additional Basic (Bronze) accounts. To request an additional account or obtain payment and setup details, contact clusterdxadm@gmail.com. ClusterDX may suspend or remove an unauthorised duplicate account.

5. Basic membership and support levels
Basic use of ClusterDX remains free. BRONZE, SILVER, GOLD and PLATINUM are voluntary support levels that help cover hosting, storage, data traffic, maintenance and continued development. Each level is assigned to one account and one callsign for a standard period of 12 months. A higher level includes the benefits of the levels below it.

The current level structure is:
BRONZE - session time up to 1 hour and essential enhanced ClusterDX, alert and logbook features.
SILVER - session time up to 2 hours, all Bronze benefits and Live QSO Session access.
GOLD - session time up to 4 hours, all Silver benefits, CDX Cockpit and 3D Globe Pro, private chat, a personal Nickpage and eligible ClusterDX award certificates.
PLATINUM - no automatic session time limit, all Gold benefits, eligible DXCC area certificates, a ClusterDX web-based email account, two additional Basic accounts and one custom digital QSL card design.

The detailed and current feature list published in the ClusterDX FAQ forms part of this section. Features may be improved, replaced or withdrawn when required for security, maintenance or further development. Support levels do not provide ownership, moderation authority or exemption from these rules.

When a support level expires, the main account remains active as a Basic account, but level-specific access is disabled. Contributions are normally non-refundable after a level has been activated, except where required by law or where ClusterDX confirms a payment error.

6. Spots, logbook entries and radio conduct
Submit a WKD spot only when you have genuinely completed the contact. Submit an SWL spot only when you have personally heard the station. False, fabricated, misleading or deliberately duplicated spots are prohibited. Check the callsign, frequency, date, time and other details before submitting a spot.

Self-spotting is not permitted. Do not use spots as advertisements for your own station, activation, contest, location, frequency or QSL route. Information that is not based on an actual WKD or SWL event should be shared through an appropriate community feature instead of the public spot window.

27.555 MHz is a calling frequency. WKD entries from 27.551 through 27.559 MHz are not accepted; move the QSO away from the calling frequency before recording it as WKD. An SWL entry may be submitted where the system permits it.

Moderators and administrators may correct or remove a spot that is clearly inaccurate, duplicated, abusive or contrary to these rules. Where practical, the member will be informed. ClusterDX does not independently guarantee that every reported QSO or SWL event took place.

7. Activations, SES events, contests and awards
Do not use ClusterDX as an unauthorised contest control platform and do not publicly spot your own Special Event Station, activation or contest operation. You may record your own SES or contest contact in your personal logbook, but it must not be presented as an independent public spot from another operator. Contact a moderator or administrator if you are unsure how an event may be announced.

ClusterDX awards, badges and trophies are digital recognition unless explicitly stated otherwise. They have no cash value and are not normally sent by post. Eligibility depends on the data available to ClusterDX and may be reviewed if relevant spots or records are found to be invalid.

8. Advertising, recruitment and misuse of communications
Unauthorised commercial advertising, fundraising, affiliate promotion, club recruitment and promotion of another cluster, node, platform, business or service are not permitted. This rule applies to spots, profiles, Nickpages, images, chat, comments, forums, downloads and private messages. A normal QSL route or factual station information in the appropriate profile field is acceptable when it is not promotional.

Do not use ClusterDX private messages as a bulk-mail system or to send spam, recruit members, pressure other users or distribute prohibited material. Messages are private between participants, but authorised staff may investigate reported messages when reasonably necessary for safety, rule enforcement or legal compliance.

9. Content and personal information
You are responsible for the content you publish and must have the right to share it. Do not post another person's private information, copyrighted material or images without permission. Avoid publishing home addresses, telephone numbers, private email addresses or other sensitive information. Use the available profile privacy settings where appropriate.

ClusterDX may use your registered email address to deliver account approval notices, security messages, password recovery, service information, important updates, moderation notices and other communications reasonably connected with your membership. How personal data is handled is further described in the ClusterDX Privacy Policy.

10. Backups, account deletion and retained records
Keep your own backups of important logbook data, eQSL cards, certificates, photos and other content. Export tools are provided where available, but ClusterDX cannot guarantee that all content will always remain available or recoverable.

Before requesting account deletion, export any data you wish to retain. Personal account data will be removed or retained in accordance with applicable law and the Privacy Policy. Public spot records may remain where necessary to preserve the integrity and history of the cluster. Limited security, moderation, payment or legal records may also be retained where there is a lawful reason to do so.

11. Prohibited technical activity and protection of ClusterDX
Without written permission, you may not scrape, harvest, copy, republish, sell, mirror or systematically extract ClusterDX spots, member data, email addresses, source code, designs, layouts or other protected content. You may not use ClusterDX data, code or branding to build or operate a competing 11-metre cluster or substantially similar service.

You may not use a ClusterDX account to conduct systematic competitive monitoring or to study, test, document or reproduce member-only or non-public features, workflows, interface structures, data organisation or operational methods for the purpose of building, operating or improving a competing or substantially similar service. Operating or contributing to a similar service, or making ordinary personal use of ClusterDX, is not by itself a violation. ClusterDX may act under this rule only where the available facts give reasonable grounds to conclude that access is being used for competitive replication, systematic extraction or circumvention rather than ordinary participation.

Do not bypass access controls, manipulate session limits, automate logins or page refreshes, embed ClusterDX in unauthorised frames, interfere with the service, probe for vulnerabilities, introduce malicious code or access another member's account. Approved ClusterDX APIs and integrations may be used only within their documented permissions and limits.

12. Moderation and enforcement
ClusterDX administrators, coordinators and moderators may edit or remove content, issue a warning, restrict a feature, suspend an account or terminate membership when reasonably necessary to enforce these rules, protect users, secure the service or comply with law. Serious abuse, fraud, threats, security attacks or repeated violations may result in immediate action without advance notice.

When considering a restriction, suspension or termination connected with competitive use, ClusterDX will consider the available evidence, the nature and pattern of access, the risk to member-only or non-public parts of the service and whether a less restrictive measure would be sufficient. Except where immediate action is reasonably necessary to prevent ongoing extraction, circumvention, security harm or other serious harm, the member will be given a written statement of the relevant facts and grounds and a reasonable opportunity to respond before a permanent termination takes effect. A decision will not be based only on the member owning, developing or contributing to another service.

Where an account or membership is restricted, suspended or terminated, ClusterDX will provide a clear statement of reasons using the electronic contact details available to it, except where doing so is prohibited by law or would create a material security risk. The member may request a review by contacting support@clusterdx.org within six months of the decision. Where practical, the review will be carried out by a person who was not solely responsible for the original decision. Any rights to export or delete personal data and any refund required by applicable law remain unaffected.

Members must cooperate with reasonable moderator instructions. Decisions will take the available evidence and the seriousness of the conduct into account. Questions about an action may be sent to the administration, but abusive or repeated messages will not be tolerated.

13. Service availability and disclaimer
ClusterDX is provided on an "as available" basis. We work to keep the service accurate, secure and accessible, but do not guarantee uninterrupted operation, permanent storage, error-free results or fitness for a particular purpose. To the extent permitted by law, ClusterDX is not liable for indirect loss, lost contacts, lost data, equipment use or decisions based on user-generated information.

Nothing in these Terms excludes rights or liabilities that cannot legally be excluded. External websites and services are governed by their own terms and are used at your own discretion.

14. Changes to these Terms
ClusterDX may update these Terms, the support-level structure or individual features to reflect legal, technical, security or operational changes. The current version and update date will be published on ClusterDX. Material changes may also be announced through the website or registered email address. Continued use after an update means that you accept the revised Terms where permitted by law.

Material restrictions on account use will not be applied retroactively as a breach of these Terms. For existing members, such restrictions take effect on the stated effective date after reasonable notice. Conduct continuing after that date may be assessed under the updated Terms.

15. Governing law and contact
ClusterDX is operated from the Netherlands. These Terms are governed by applicable Dutch law and European Union law, without limiting mandatory rights that may apply in your country. Disputes should first be raised with ClusterDX administration so that an informal solution can be attempted.
